Your access to and use of the Aboitiz Power Corporation (“AP”) Official Website (“Site”) is subject to these Terms of Use (“Terms”) and all applicable laws and regulations.

By accessing and using the Site, you accept these Terms without limitation or qualification and acknowledge that any other agreements between you and AP  on this subject matter are superseded.

If you do not agree to these Terms without limitation or qualification, please leave the Site.

1. Ownership and Use of Content

The Site and all its contents including text, images, trademarks, logos, and services marks ("Content") are owned or licensed by AP and are protected under applicable intellectual property laws.

Unauthorized use of the Content, except as expressly permitted under these Terms, is strictly prohibited. AP will enforce its intellectual property rights to the fullest extent of the law.

2. Your Use of the Site

AP grants you permission to use the Site under the following conditions:

- You may download or print Content for personal, non-commercial use only, provided that all copyright and proprietary notices are retained;

- You may use materials available in the Media Center section of the Site (“Media Center”) solely for editorial purposes in newspapers and magazines of general circulation, trade publications and broadcast media;

- You may not download, use images or content of individuals or specific facilities outside of the Media Center;

- You are prohibited to modify, distribute, copy (except as permitted above), transmit, display, reuse, reproduce, publish, license, create derivative works from, or sell any Content without prior written consent from AP;

- You are prohibited from using the Site to post or transmit any unlawful content or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. AP will cooperate with law enforcement authorities or any court order requesting AP to disclose the identity of anyone posting or transmitting any such information or materials; and

- You are prohibited from using the Site for unsolicited commercial or marketing activities.

3. Privacy

Any personal data you transmit to the Site (for example, your name, address, telephone number or e-mail address) will be used by AP  in accordance with the company's Privacy Statement.

All other communication, including  questions, comments, or suggestions comments or suggestions, will be considered non-confidential and nonproprietary.

4. Disclaimer of Warranties

All Content and information on the Site may be changed without notice. These are provided to you on an "as is" basis, without any warranty, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement.

Some jurisdictions may not allow the exclusion of implied warranties, so some of the exclusions above may not apply to you. Without limiting the foregoing, AP does not warrant or represent that your use of any Content will not infringe the rights of any third parties.

AP uses reasonable efforts to update information on the Site. However, AP  makes no warranties or representations on the accuracy, correctness, or reliability of these pieces of information. Accordingly, AP  shall not be liable or responsible for any omissions or errors on the Site (including, without limitation, typographical errors and technical errors).

AP shall not be liable or responsible for infringing, false, misleading, abusive, harassing, defamatory, obscene, scandalous, inflammatory, or otherwise unlawful content on the Site, including any discussions, chats, postings, transmissions, bulletin boards, and the like that may be located therein.

5. Exclusion of Liability

You assume full responsibility and risk for your use of the Site. AP, its subsidiaries, affiliates, officers or directors, employees, agents or any other party involved in creating and updating the Site,  are not liable for any direct, indirect, punitive, incidental, special, consequential or other damages arising from the use of the Site whether based on contract, tort, strict liability or otherwise, even if advised of the possibility of any such damages.

In the event of any problem with the Site, you agree that your sole remedy is to cease access and/or use of the same.

Some jurisdictions may not allow the exclusion of certain damages, so some of the exclusions above may not apply to you.

The Site may contain links to third-party websites. . These links are provided only for your convenience. AP does not endorse, control, or take responsibility for their content or privacy practices.

You access third-party sites at your own risk.

Without limiting the foregoing, AP specifically disclaims any responsibility if such sites:

- Infringe any third party's intellectual property rights;

- Are inaccurate, incomplete or misleading;

- Are not merchantable or fit for a particular purpose;

- Do not provide adequate security;

- Contain viruses or other items of a destructive nature; or

- Are libelous or defamatory.

AP  does not endorse the content, or any products or services available, on these sites. If you establish a link to such sites or the Site, you do so at your own risk and without the permission of AP.

7. Export Control

AP does not authorize the download or export of software or technical data from this Site to any jurisdiction where such action is restricted by Philippine export control laws.

AP  reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with AP  in asserting any available defenses. These provisions survive the termination of these Terms or your access to or use of the Site.

These Terms constitute the entire agreement between you and AP  concerning the Site. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

AP  may revise these Terms anytime without notice. You are bound by such revisions and should periodically visit this page to view the current Terms.

12. Law and Jurisdiction

These Terms and your use of the Site are governed by the laws of the Philippines, without regard to its choice of law provisions. Any dispute arising out of or relating to these Terms and the use of the Site shall be resolved exclusively by the courts of general jurisdiction located within Makati City, Philippines, to the exclusion of all other courts

Why does AP use cookies and other data collection technology?

The types of cookies served on through the Site and why they are used are as follows:

- Strictly necessary cookies are required for the Site to operate.

Data collection technology enables AP  to monitor the traffic patterns from one webpage to another, to deliver or communicate with cookies, to understand whether users visit the Site after seeing our online advertisement displayed on a third-party website, to improve performance of the Site and to measure the success of our email marketing campaigns.

Where permitted by applicable law, the Site uses Google Analytics for targeted advertising (which Google sometimes refers to as ‘remarketing’). Google uses cookies that Google recognizes when consumers visit various websites. The data collected through Google’s cookies helps AP  analyze how the Site is used and to personalize marketing communications and digital advertising.

The Site also embeds videos from YouTube (a Google company) by framing. This means that, after you click the button to play a YouTube video through the Site, a connection between the Site and the YouTube servers is established. Then, an HTML link provided by YouTube is inserted into the code of the Site to create a playback frame. The video stored on the YouTube servers is then played by the frame in the Site. YouTube also receives information that informs YouTube that you are currently using the Site: your IP address, browser information, the operating system and settings of the device you are using, the URL of the current web page, previously-visited web pages if you have followed a link, and the videos you watched. If you are logged into your YouTube account, the information may be associated with your YouTube user profile. You can prevent this association by logging out of your YouTube account before using the Services and deleting the corresponding cookies.

On behalf of AP, Google will use the data described above to compile reports that help AP operate and provide the Services.
